Terms of Service

These Terms of Service ("Terms") govern your access to and use of interstellarxp.com and all related services operated by Interstellar Express("we", "us"). By creating an account or using the platform, you agree to these Terms. If you do not agree, do not use the platform.

1. The Service

Interstellar Express is a pixel-art platform where users paint and submit wagon artwork that is permanently displayed on a continuously scrolling pixel-art train. Additional features include:

• Galaxy FM — a community-curated chiptune radio station embedded in the platform.
• Competitions — periodic themed pixel-art contests.
• Leaderboard & profiles — public pages showing user contributions and achievements.
• Donations — voluntary financial support with optional donator tier recognition.

2. Eligibility

You must be at least 16 years old to create an account. By registering, you confirm that you meet this age requirement. Users under 18 must have parental or guardian consent.

3. Account Registration

You must provide a valid email address and a password of at least 6 characters. You are responsible for all activity under your account and for keeping your credentials confidential. Notify us immediately at sparks@interstellarxp.com if you suspect unauthorised access.

One person may maintain one primary account. Multiple accounts created to circumvent moderation decisions may be terminated without notice.

4. User-Generated Content

4.1 Your content, your ownership

You retain full copyright in the pixel art, audio tracks, and other original content you upload ("User Content"). By submitting content, you grant us a worldwide, non-exclusive, royalty-free licence to display, reproduce, and distribute it solely for operating and promoting the platform. This licence ends when your content is deleted, subject to cached or archived copies.

4.2 Warranty

You warrant that: (a) you own or have all necessary rights to your content; (b) it does not infringe any third-party intellectual property rights; (c) it complies with our Community Guidelines; and (d) it complies with all applicable laws.

4.3 Content moderation

All user content is reviewed by our moderation team before public display. We reserve the right to reject, remove, or restrict content that violates these Terms or our Community Guidelines, without liability to you.

5. Payments

Payments are processed via Stripe and are non-refundable once submitted to moderation. If your submission is rejected and you believe it was in error, contact us within 14 days. Refunds at our sole discretion are processed back to your original payment method within 5–10 business days.

All prices include applicable VAT where required by EU law. Stripe is the merchant of record and handles all payment disputes (chargebacks).

6. Prohibited Conduct

You agree not to:

• Submit content that is illegal, hateful, defamatory, obscene, or harassing.
• Infringe third-party intellectual property rights.
• Attempt to reverse-engineer, disrupt, or exploit the platform or its APIs.
• Use automated tools (bots, scrapers) to interact with the platform without prior written consent.
• Circumvent moderation decisions by creating duplicate accounts.
• Submit spam, commercial solicitations, or misleading content.
• Upload malware, scripts, or any code intended to harm users or our infrastructure.

7. Our Intellectual Property

All platform software, design, branding (including "Interstellar Express", "Galaxy FM", "Dr. Zoltan Quantumsparks", and the train artwork and UI), and documentation are our exclusive property. Nothing in these Terms grants you a licence to use our intellectual property except as strictly necessary to use the platform.

8. Copyright Infringement (DMCA)

If you believe content on our platform infringes your copyright, send a notice to legal@interstellarxp.com with: (a) identification of the copyrighted work; (b) identification of the infringing content and its URL; (c) your contact information; (d) a good-faith belief statement; and (e) a declaration of accuracy under penalty of perjury. We will act promptly on valid notices.

10. Limitation of Liability

To the maximum extent permitted by EU law, our total liability for any claim arising from your use of the platform is limited to the greater of: (a) €10; or (b) the total amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

Nothing in these Terms limits liability for: death or personal injury caused by negligence; fraud or fraudulent misrepresentation; or any other liability that cannot be excluded under EU consumer law.

11. Termination

You may delete your account at any time by contacting sparks@interstellarxp.com. We may suspend or terminate your account for material breach of these Terms, with or without notice. Upon termination, your licence to use the platform ends immediately. Content already published on the train may remain visible in archived form unless specifically requested for removal.

12. Governing Law & Disputes

These Terms are governed by the laws of Ireland and the European Union. Any disputes will first be attempted to be resolved amicably via email. Failing that, disputes are subject to the exclusive jurisdiction of the Irish courts, without prejudice to your rights as an EU consumer to bring proceedings in your country of residence.

EU consumers may also use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

13. Changes to These Terms

We may update these Terms. Material changes will be communicated to registered users by email at least 14 days before taking effect. Continued use after that date constitutes acceptance. If you object, you may terminate your account before the changes take effect.
